The following terms and conditions govern the sale of products and services on our App “ASD Repair” by NC Technologies Inc. By submitting your order/ticket to us, you are indicating acceptance to be bound by these terms and conditions. These terms and conditions may be changed without prior notice at the sole discretion of NC Technologies Inc.
The products and pricing listed on our App are not to be considered offers to sell, but rather advertisements to receive offers of purchase. All orders are subject to review and acceptance by NC Technologies Inc. All prices are subject to change so your order may not be accepted or you may be advised of issues of pricing or availability in regards to your order.
Order Acceptance Policy:
Receipt of order confirmation sent to you does not signify our acceptance of the order nor does it constitute confirmation of an offer to sell. NC Technologies Inc. reserves the right to accept or decline your order for any reason at any time after receiving your order. Only based on shipping confirmation will our acceptance of your order be confirmed. All orders must be pre-approved with an acceptable method of payment before shipment occurs. We may need additional information for verification purposes before we accept any order.
Prices:
All prices shown on “ASD Repair” App are in Canadian Dollars and do not include the applicable taxes unless otherwise noted. The prices do not include shipping and handling nor any other services such as insurance. Price charged for orders will be the price at the time of the order.
Typographical Errors:
NC Technologies Inc. reserve the right in the event of any item listed at an incorrect price or with incorrect information due to a typographical error or an error on information received from our suppliers to decline and/or cancel any orders for the incorrectly listed item. We may cancel at our discretion orders which may or may not have been confirmed including orders which may have been paid for or charged to your credit card. In the event a charge has been made to your credit card, NC Technologies Inc. will immediately issue a credit to your card to offset the purchase.
Errors or Misprints
NC Technologies Inc. strives to ensure the information on its “ASD Repair” app is current and accurate. However, we cannot warrant or guarantee against any errors, inaccuracies, or omissions on its website or flyers nor does it offer compensation or accept liability for any consequences arising thereof. NC Technologies Inc. reserves the right to correct any errors, omissions, or inaccuracies relating to the products, pricing or any other information or pictures on the “ASD Repair” app without prior notice or liability to you or any other person. In addition, NC Technologies Inc. reserves the right to reject, cancel or terminate any order, including accepted orders for any reason and without liability or prior notice to you or any other person.
Shipping & Handling and Taxes:
You, the buyer, are responsible for all applicable charges including but not limited to: shipping, handling, delivery, taxes and applicable tariffs associated with the purchase.
Risks associated with shipping:
When NC Technologies Inc. ships the product, our liability for damage or breakage on the shipment will be limited to the coverage provided by the carrier's terms and conditions. You may wish to purchase additional insurance coverage for the full value of the product when you order. The appropriate request should be made when you submit your order request. NC Technologies Inc. does not give any delivery guarantee such as specified time or date. All shipping dates are estimated from information provided by the carrier and internal processing time.
Payment Terms:
Payment may be made by online bank payment or credit card. Orders will only be processed based on confirmation of payment.
Limitation of Liability:
The maximum liability to you on products purchased from NC Technologies Inc. shall be limited to the purchase price of the products you paid. NC Technologies Inc. will not be liable for any property damage, personal injury, loss of use, interruption of business, loss of profits, or other consequential, indirect, incidental, punitive or special damages. This applies in all cases however caused, whether for breach of warranty, contract, tort (including negligence), strict liability or other reasons. Some of these limitations may not apply in some jurisdictions and those damages limitations not allowed under by exclusion or restriction under law may not apply to you.
Interpretation:
These terms and conditions shall be interpreted under and governed by the federal laws of Canada, without giving effect to conflict of laws rules. The headings used in these Terms and Conditions are for reference purposes only and are not intended to be part of or affecting the meaning of these Terms and Conditions.
Severability:
If any provision of these Terms and Conditions is held to be illegal, invalid or un-enforceable, in whole or in part, the legality, validity and enforceability of the remainder shall not be affected nor impaired. The Terms and Conditions stated herein are declared to be Severable.
PRIVACY POLICY
NC Technologies inc. is committed to ensuring the privacy and protection of all our customers. This policy was developed with this goal in mind and outlines the guidelines in which we gather personal and non-personal information and the use of such information. In the process of engaging in commerce with our customers, we do not store any payment information such as credit card and bank account info on our web servers. Only basic customer info is store on our secure server to enable us to execute each order request. Payment processing is not provided on our app.
Definitions
For the purposes of this statement, personal information includes your name, address, account information, company name, email address, telephone number and any other information which identifies you. "We, us, our" refers to NC Technologies Inc. and our affiliated companies. Non-personal information refers to all non-identifiable information such as your IP address, referring website, browser type, and navigation on the website as well as consolidated demographic information which does not contain individual information.
Gathering Of Personal Information
In order to identify the user of the account, we required information of the individual user and company. The information is collected during the user account registration. gathers your information to both verify your identity (to prevent fraud) and to facilitate your request. By providing your information in association with your request you are giving us your expressed consent in using that information to provide you the service or transaction you requested. This information is store on a secured site. Information collected in this manner is used solely for processing your request. We may collect and summarize this information in such a manner where no individual may be identified for statistical purposes to help us improve our business practices and provide better service to you.
Access To And Releasing Of Information
Payment Processing : This process is a separate process and not integrated with our “ASD Repair” App. When you execute an order on our “ASD Repair” app, in a separate process, your name, address, credit card number and amount purchased will be submitted to your financial institution to verify your identity and to authorize your purchase. We must also supply your name, telephone number, address and items purchased to third party shippers such as UPS to deliver your order to you. There may also be instances where we may drop ship directly from the manufacturer or one of our suppliers. In these instances they are the shipper for this order and given the same information.
Independent Contractors : From time to time, we may employ other companies or individuals to provide certain services to us such as analyzing customer lists and data, providing marketing assistance, or consulting services. These third parties will have access to the information needed to perform their functions but cannot use that information for any other purpose. Any 3rd parties who use our data will be fully bound by this privacy policy.
Legal Disclosure:
We may disclose your information as permitted or required to by law; for example :
- To a government institution or other person or entity that has asserted its lawful authority to obtain the information.
- Where we have reasonable grounds to believe the information could be useful in the investigation of unlawful activity.
- To comply with a subpoena or warrant or an order made by a court, person or entity with jurisdiction to compel the production of information.
- To comply with court rules regarding the production of records and information.
- To our legal counsel.
